Pre-Submission / Planning & Zoning Appeals Board

Pre-Submission Conference and Planning Board Meetings

All new businesses must file with the Pre-Submission/Planning Board,

The Pre-Submission Conference is a Concept plan/Initial Site Plan Review Board. The Board reviews plans to assure that such plans conform to Village Codes.

Once the applicant has appeared before the Pre-Submission Board depending on the nature of the application, the applicant may need to appear before other Boards and Commissions prior to the Planning Board. (E.g. Zoning, Traffic & Safety).

The Planning Board then reviews and approves site plans for all new businesses, subdivisions, new construction, and building additions, including detached accessory structures.

Zoning Board of Appeals

The Board of Zoning Appeals is authorized to hear appeals in matters taken by the Building Department related to the zoning ordinances of the Village of Hempstead. Village Law §7-700 grants villages the power to zone and more power to control the development within its boundaries for the purpose of promoting the health, safety, morals, or general welfare as follows:

To regulate and restrict the height, number of stories, and size of buildings and other structures, the percentage of lot that may be occupied, the size of yards, courts, and other open spaces, the density of population, and the location and use of buildings, structures and the land for trade, industry, residence or other purposes.

The Zoning Board of Appeals operates on the foundation of the zoning law and is responsible for upholding the regulations adopted. Each case is brought before the board and once all evidence is reviewed and due deliberation, the board may render a formal written decision pursuant to the village’s local zoning law.

Should you wish to make an application to the Zoning Board of Appeals for a variance/special exception, please contact the Building Department to obtain the necessary forms.
