HEMPSTEAD JUSTICE COURT RULES
BY ORDER OF VILLAGE JUSTICE TANYA HOBSON-WILLIAMS

COURT SESSIONS ARE:

9:00 AM    NO ADMITTANCE AFTER  10:15 A.M.
1:00 PM    NO ADMITTANCE AFTER    2:15 P.M.
7:00 PM    NO ADMITTANCE AFTER    8:15 P.M.

  1. ALL ATTORNEYS AND DEFENDANTS MUST BE SEATED IN THE COURTROOM PRIOR TO THE CLOSE OF CHECK-IN TIME.
     
  2. NO ONE WILL BE ADDED TO THE CALENDAR AFTER THE CLOSE OF CHECK-IN TIME. no exceptions.
     
  3. All motions must be in writing with the original filed with the court.
     
  4. Any requests for adjournments should be in writing at least one week before their scheduled court date. 
     
  5. Attorneys who adjourn due to engagement of counsel must comply with part 125 of the Rules of the Chief Administrative Judge. 
     
  6. Any requests to vacate a Default Judgment must be done by motion in writing or by stipulation signed by both parties and So Ordered by the Chief Judge (THW). Oral applications are not acceptable.
     
  7. All attorneys must have written authorization to appear and enter into a plea on behalf of their client.
     
  8. Defendants under the age of 18 must appear with a parent or legal guardian, with proof of relation.
     
  9. Requests for hardship, assigned counsel or community service must be accompanied with documentation of hardship, such as documentation from the Department of Social Services, NYS Department of Labor/ Unemployment, proof of income, proof of child support payments/receipts, Disability benefits, proof of rent/mortgage.
     
  10. The court will only accept Original Documents.

PROPER ATTIRE MUST BE WORN AT ALL TIMES INSIDE THE COURTROOM

  • No bare feet.
  • No bare chest.
  • No hats, scarves or other head covers unless for religious purposes.
  • No shorts.
  • No short skirts.
  • No low cut shirts or tops.
  • No halter tops.
  • No uniforms of any kind.
  • No clothing that reveals undergarments.

ADDENDUM TO THE VILLAGE OF HEMPSTEAD COURT RULES

  1. All motions must be in writing, no oral motions will be entertained. 
     
  2. All attorneys must provide original documents to the Court.
     
  3. All attorneys must have and present to the Court, written authorization to represent their clients whether a person or a corporation.
     
  4. Attorneys are permitted to pay fines with attorney checks.
     
  5. Special Trial Dates can be scheduled upon application to the Court.
     
  6. Default Judgments can only be vacated by submission of a written motion.
     
  7. Trials and Hearings’ adjournments are only allowed with the permission of the Judge.
     
  8. Documentation must be submitted with all applications of hardship.  Only originals will be accepted.  All original documents will be returned.
     
  9. NO requests for adjournments should be sent via facsimile.
     
  10. To request an adjournment, attorneys must submit an affirmation of actual engagement.
